REGULATION
ON THE ACCREDITATION PROCEDURE
IN THE  PRIDNESTROVIAN MOLDAVIAN REPUBLIC
FOR JOURNALISTS OF THE FOREIGN MASS MEDIA
AND FOREIGN INDEPENDENT JOURNALISTS (FREELANCERS)

 

  1. General provisions
  1. The present Regulation establishes the accreditation procedure for journalists of the foreign mass media and foreign independent journalists (freelancers) in the territory of the Pridnestrovian Moldavian Republic, which is carried out by the Ministry of Digital Development, Communications and Mass Media of the Pridnestrovian Moldavian Republic (hereinafter – the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic). The Present Regulation do not affect the features of accreditation procedure implemented by other state authorities of the Pridnestrovian Moldavian Republic.
  1. In order to widely inform the world community about interior and international life of the Pridnestrovian Moldavian Republic journalists of the foreign mass media including those with official representative offices in the Pridnestrovian Moldavian Republic, foreign independent journalists (freelancers) may operate in the territory of the Pridnestrovian Moldavian Republic only if they have accreditation of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
  1. The legal status and professional activity of journalists of the foreign mass media and foreign independent journalists (freelancers) accredited in the Pridnestrovian Moldavian Republic is regulated by the Constitution of the Pridnestrovian Moldavian Republic, the current legislation of the Pridnestrovian Moldavian Republic, international treaties, as well as the Present Regulation.
  1. For the purposes of the Present Regulation:
  2. a) Accreditation means the official recognition of the credentials of journalists of the foreign mass media, their representative offices and foreign independent journalists (freelancers) to carry out journalistic activities in the Pridnestrovian Moldavian Republic for a period specified in the accreditation by the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.

To carry out journalistic activities journalists need to have the approval of other Competent Public Authorities in accordance with the current legislation of the Pridnestrovian Moldavian Republic;

  1. b) Journalists mean the editors, correspondents, photographers, cameramen, film editors and technical staff arriving with the journalist(-s) of the foreign mass media;
    c) Representative offices of foreign mass media mean the separate subdivision of the legal entity — foreign mass media, based outside its location, which represents and protects the interests of the legal entity;
  2. d) The foreign independent journalist (freelancer) means a foreign resident carrying out journalistic activities independently (as a reporter, photographer, cameraman, video editors, etc.) having no employment relationship with the foreign media, declaring the independent implementation of journalistic activities.
  1. Accreditation is performed by the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic over the application of a foreign mass media editorial, its representative office and (or) foreign independent journalist (freelancer) (hereafter – the application) after the Competent Public Authority of the Pridnestrovian Moldavian Republic receives recommendations and ratification. After receiving recommendations and appropriate approval by the Competent Public Authority of the Pridnestrovian Moldavian Republic.
  1. The journalists of foreign mass media, their representative offices and foreign independent journalists (freelancers) accredited in the Pridnestrovian Moldavian Republic have professional status of journalists, established by the current Law on Press and Other Mass Media of the Pridnestrovian Moldavian Republic regardless of their citizenship.
  1. Types of accreditation
  1. There are two types of accreditation to receive an official credential recognition of foreign mass media, their representative offices and foreign independent journalists (freelancers) in the Pridnestrovian Moldavian Republic:
  2. a) long term accreditation is granted for a one-year period with an option to extend accreditation validity for journalists of foreign mass media, their representative offices opened as required by the law of the Pridnestrovian Moldavian Republic and foreign independent journalists (freelancers), who have the status of a legal person in the territory of the Pridnestrovian Moldavian Republic.
  3. b) short-term accreditation with specification of concrete dates is granted to the journalists of a foreign mass media and foreign independent journalists (freelancers) for the period of their stay in the Pridnestrovian Moldavian Republic (for the term up to three months) to report on the time-bound events or to replace long-term accreditation in case of vacation, illness, business trip of a journalist to another country.
  1. The extension of the accreditation is carried out upon receipt of the relevant application from the editorial office of the foreign media and (or) a foreign independent journalist (freelancer).
  1. The accreditation procedure
  1. The application shall be executed on the official form of the foreign mass media, signed by the head (owner). The application may be filled as an official letter from a foreign independent journalist (freelancer). For short-term accreditation the application can be submitted by e-mail in *.JPG (*.JPEG), *.BMP, *.TIFF file format. The application shall include:
  2. a) full name of foreign mass media, its information orientation (political, economic, social, cultural, sports, etc.), the location of the editorial office (representative office), the distribution region, postal address, telephone and fax numbers of the editorial office, electronic means of communication (if any) — e-mail, ICQ, VoIP etc. (for the foreign mass media editorial office);
  3. b) a surname, name, patronymic (if the patronymic is used) and the post of the journalist(-s) of a foreign mass media and (or) of a foreign independent journalist(-s) (freelancer(-s)), submitted for accreditation;
  4. c) an editorial assignment specifying concrete defined implemented objectives or with an indication of the event to be covered;
  5. d) the period of accreditation.
  1. When an independent journalist (freelancer) applies for the accreditation, the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic has the right to request additional information regarding the professional activities of the foreign independent journalist (freelancer) (i.e., exemplary information and other materials posted on websites, published, broadcast for previous periods, but not earlier than three years ago).
  1. The application shall include 1 (one) photo (3×4 cm), copy(-s) of the document(-s) certifying the identity of a journalist(-s) of a foreign mass media and (or) a foreign independent journalist(-s) (freelancer(-s)) applying for accreditation, as well as a list of technical devices and equipment imported into the territory of the Pridnestrovian Moldavian Republic (if available).
  1. When applying for long-term accreditation, it is necessary to submit the following documents:
  2. a) a certificate of the editorial staff of the foreign mass media representative office (name, position, passport data);
  3. b) an extract from the Unified State Register of Legal Entities of the Pridnestrovian Moldavian Republic in Russian;
  4. c) an extract from the Unified State Register of Real Property Rights and Transactions in the territory of the Pridnestrovian Moldavian Republic. If the real estate is registered earlier than 2001, a certificate from the Technical Inventory Office should be provided.

If ownership of real estate is based on a lease agreement not requiring state registration, it is necessary to submit a notarized copy of the lease agreement;

  1. d) a certificate on the status of payments of a legal entity (representative office) to the budget issued by the Tax Authority of the Pridnestrovian Moldavian Republic at the place of registration of the legal entity.
  1. Excluded.
  1. The application is submitted to the Head of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
  1. To receive a short-term accreditation the application should be sent to the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic to the postal address –

The application shall be submitted not less than 30 (thirty) days prior to the accreditation date specified in the application, except for cases when the applicant sends a reasoned request about impossibility of compliance with this period.

  1. The application received the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic is considered accepted from the moment of its registration in the Office of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
  1. An application for accreditation issued in violation of the requirements of the Present Regulation shall be returned to the foreign mass media and (or) a foreign independent journalist (freelancer) within 2 (two) working days from the date of registration, indicating the reason for the return.

This circumstance does not deprive a foreign mass media and (or) a foreign independent journalist (freelancer) of the right to resubmit a duly executed application.

  1. The Mass Media Executive Authority of the Pridnestrovian Moldavian Republic undertakes the preliminary consideration of duly executed application within 4 (four) working days from the date of its adoption.
  1. Within 4 (four) working days, the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic sends the application for approval to the relevant Competent Public Authorities of the Pridnestrovian Moldavian Republic, that submit their recommendations to the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
  2. Denial of accreditation is possible if:
  3. a) the information specified in the application does not correspond to reality, photos, other documents defined by the Present Regulation are not attached to the application;
  4. b) the application is submitted in violation of the deadlines established by the Present Regulation;
  5. c) the journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) is already accredited;
  6. d) foreign mass media and (or) a foreign independent journalist (freelancer) disseminated information that does not correspond to reality, degrading the honor and dignity of citizens and (or) damaging the business reputation of Pridnestrovian organizations and (or) damaging the interests of the Pridnestrovian Moldavian Republic, as well as disseminating false or distorted information that may harm friendly relations between states;
  7. e) a journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) has previously carried out journalistic activities in the Pridnestrovian Moldavian Republic without receiving accreditation;
  8. f) a journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) has previously been deprived of accreditation in the territory of the Pridnestrovian Moldavian Republic;
  9. g) the Competent Public Authority has sent a non-agreement letter for accreditation of the journalist(-s) of a foreign mass media and (or) an independent foreign journalist (freelancer).
  1. The decision to issue accreditation is executed by an order of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic.
  1. The Mass Media Executive Authority of the Pridnestrovian Moldavian Republic informs about the application consideration results of a journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) no later than 2 (two) working days before the deadline of accreditation commencement specified in the application.

In order to accelerate the accreditation procedure, a journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) can be informed about the positive solution via the phone or by email indicated in the application.

The Denial of accreditation is issued in the form of an official letter signed by the Head of the Ministry of Digital Development, Communications and Mass Media of the Pridnestrovian Moldavian Republic indicating the reasons and grounds for the refusal.

  1. The Mass Media Executive Authority of the Pridnestrovian Moldavian Republic draws up and issues an accreditation card to a journalist(-s) of a foreign media and (or) a foreign independent journalist (freelancer) successfully applied for the accreditation (according to Annex №3 to the Present Regulation).
  1. The professional activities of a journalist of a foreign mass media and (or) a foreign independent journalist (freelancer) without an accreditation certificate is not allowed.
  1. When carrying out journalistic activities on the territory of the Pridnestrovian Moldavian Republic journalist(s) of a foreign mass media editorial and (or) a foreign independent journalist (freelancer) shall provide an accreditation certificate and the document proving the identity at the request of authorized entities.
  2. When conducting journalistic activities in the territory of the Pridnestrovian Moldavian Republic, a journalist(-s) of a foreign mass media and (or) a foreign independent journalist (freelancer) are obliged to present an accreditation card as well as an identity document at the request of authorized entities.
  1. A journalist(-s) of a foreign mass media and (or) a foreign independent journalist (freelancer) receives an accreditation card personally no later than the day of the accreditation start. There should be an appropriate entry made in the Log of Registration and Issuance of Accreditation cards in the territory of the Pridnestrovian Moldavian Republic.

Accreditation card includes:

  1. a) ID number;
  2. b) date of card issuance;
  3. c) name of the foreign mass media (for the foreign media edition offices);
  4. d) photo, surname and name (initials) of accredited journalist and (or) representative of foreign media;
    e) period of accreditation.
  1. The accreditation card is signed by the Head of the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic and is certified with an official seal.
  1. Termination and deprivation of accreditation
  2. The accreditation is terminated in case of:
  3. a) termination or suspension of the activities of the foreign mass media;
  4. b) termination of labor or other civil legal relations of an accredited journalist with the editors of a foreign mass media;
  5. c) withdrawal of an accredited journalist by the editors of a foreign mass media;
  6. d) expiration of accreditation period;
  7. e) depriving a journalist of accreditation.
  1. In case if foreign mass media terminate labor, civil-law relations with the accredited journalist or withdraw him, editorial office of the mass media is obliged to inform the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic about it in written form to terminate accreditation of this journalist.
  1. A foreign mass media can apply for accreditation of another journalist after returning a previously issued accreditation card.
  1. A journalist(-s) of the foreign mass media and (or) the foreign independent journalist (freelancer) may be deprived of accreditation if:
  2. a) the journalist(-s) of a foreign mass media and (or) the foreign independent journalist (freelancer) violate the established rules of accreditation or disseminate untrue information that defames the honor and dignity of the organization that accredited the journalist(-s) of a foreign media and (or) a foreign independent journalist (freelancer), and it is confirmed by legally effective court decision;
  3. b) the journalist(-s) of a foreign mass media and (or) the foreign independent journalist (freelancer) defies the current legislation of the Pridnestrovian Moldavian Republic;
  4. c) the journalist(-s) of a foreign mass media and (or) the foreign independent journalist (freelancer) disseminates information prohibited by the current legislation of the Pridnestrovian Moldavian Republic or prejudicial to the interests of citizens, organizations and (or) the State.
  1. In case of deprivation of a journalist(-s) of a foreign mass media and (or) a foreign independent journalist (freelancer) accreditation the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic within 4 (four) working days publishes an information message in the republican newspaper “Pridnestrovie” about the accreditation card registered with the indicated in the information message ID number is considered invalid, and sends a written notification to the journalist about the deprivation of his/her accreditation.
  1. The journalist(-s) of a foreign mass media and (or) the foreign independent journalist(-s) (freelancer(-s)) deprived of accreditation are required to submit the accreditation card to the Mass Media Executive Authority of the Pridnestrovian Moldavian Republic within 2 (two) working days from receipt of written notification.
  1. The re-accreditation of the deprived of accreditation journalist(-s) of a foreign mass media and (or) the foreign independent journalist(-s) (freelancer(-s)) is not allowed.
  1. The decision on denial of accreditation or deprivation of accreditation can be appealed in the court in in accordance with the procedure established by the current legislation of the Pridnestrovian Moldavian Republic.
